1. Who you are contracting with
The KYN service ("KYN", "Service") is provided by Simon Loftus, trading as KYN ("we", "us"). By creating an account or using KYN, you enter into a binding agreement with Simon Loftus.
2. Acceptance
By continuing to use KYN you agree to these Terms. If you do not agree, do not use the Service. You confirm you are of legal age in your jurisdiction (or have parental consent) and, if signing up on behalf of an organisation, that you have authority to bind it.
3. The Service
KYN provides AI-assisted endurance coaching: training plan generation, workout tracking, and adaptive feedback based on heart rate, RPE, and recovery data. KYN is a fitness tool — it is not medical advice. Consult a qualified professional before starting any new training program.
4. Your account
You must provide accurate information, keep it updated, and keep your credentials confidential. You are responsible for all activity under your account.
5. Acceptable use
You must not:
- Use the Service unlawfully, fraudulently, or to send spam.
- Infringe intellectual property or other rights.
- Interfere with the Service's security, probe, scan, or scrape it, or introduce malware.
- Resell, redistribute, reverse engineer, or circumvent technical limits of the Service.
6. Intellectual property
We retain all rights in the Service, its software, content, and branding. You are granted a limited, non-exclusive, non-transferable right to use KYN within your subscription plan. You retain ownership of training data and content you submit, and you grant us a limited licence to host and process it solely to provide the Service.
7. Payment terms — Paddle as Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Billing, taxes, subscription renewals, cancellations, and refunds are handled according to Paddle's Buyer Terms.
Subscriptions renew automatically at the end of each billing period (monthly or yearly, as selected) until cancelled. You may cancel at any time via your account or via paddle.net; access continues until the end of the paid period.

See our Refund Policy. Refunds are processed by Paddle.
9. Service level and disclaimers
The Service is provided "as is". We do not guarantee uninterrupted or error-free operation, and we disclaim all implied warranties (including merchantability and fitness for a particular purpose) to the fullest extent permitted by law. Training outcomes vary by individual; KYN does not guarantee performance, race results, or injury prevention.
10. Limitation of liability
To the fullest extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages, including lost profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence, or any liability that cannot be excluded by law.
11. Indemnity
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
12. Suspension and termination
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated/serious policy violations. On termination, your right to use the Service ends; you may request an export of your data within 30 days, after which it may be deleted.
13. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after changes constitutes acceptance.
14. Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory local law provides otherwise.
